The Dewey County Commissioners met on Tuesday, February 4, 2020 at 10:00 a.m. in the Dewey County Courthouse. Chairman Bob Berndt called the meeting to order. Present: Commissioners Rod Enright, Bob Keckler, Dee Ann Lawrence and John Meginness. Absent: None. Rod Enright made a motion to approve the minutes of the January 7, 2020 regular meeting and the January 27, 2020 special meeting without reading. Dee Ann Lawrence seconded it and motion carried.

LES MAYER, SHERIFF

Mayer stated that Amber Cooper of Eagle Butte is willing to help at the Sheriff’s Office while Deputy Ashley Arpan is out on medical leave. Cooper is a certified law enforcement officer. Discussion was held on advertising for a Deputy Sheriff since Mayer is scheduled to retire June 30, 2020. Rod Enright made a motion to advertise for a full time Deputy Sheriff and Dee Ann Lawrence seconded it. Motion carried. The position will be advertised local and statewide. Mayer briefly reported on a stolen property case in Eagle Butte and a hit and run incident in Timber Lake. John Meginness and Rod Enright briefly reported on the Walworth County Jail meeting they attended on January 14, 2020.

ABATEMENT

Lemburg reported that a mobile home that is no longer located in Dewey County was erroneously put on the tax rolls. She asked the board to consider abating the taxes on Record #5970 for $458.38. Dee Ann Lawrence made a motion to approve the abatement and John Meginness seconded it. Motion carried.

THREE RIVERS BUDGET

REQUEST

Lemburg reported that Three Rivers of Lemmon, SD is requesting their 2020 budget of $5,000. Dee Ann Lawrence made a motion to release the budgeted funds and John Meginness seconded it. Motion carried.

AUDITOR POSITION

The board briefly discussed allowing Auditor Lemburg to help train the new auditor. State’s Attorney Steve Aberle will prepare a written contract. Bob Keckler made a motion to increase Deputy Auditor Cherie Leibel’s wage to $24.00 per hour, effective February 10, 2020, until a new auditor is appointed. Dee Ann Lawrence seconded it and motion carried. Lemburg briefly discussed the additional job duties she handled while in her position. She encouraged the board to give some of those duties to other employees.

KYRIE LEMBURG, AUDITOR

Deputy Auditor Cherie Leibel will be attending an election equipment training in Hyde County on February 21, 2020. Therefore, the Auditor’s Office will be closed that day. Lemburg presented the following items to be surplused: HP Compaq Laptop Serial #CNU7280WX4; HP Docking Station Serial #CNU724X247; Dell Computer Serial #CFTJW12; Dell Computer Serial #CF6DW12; Dell Computer Serial #121KJ02; Dell Computer Serial #121JJ02; HP Computer Serial #MXL2462MZD; metal book shelf and metal book rack. Bob Keckler made a motion to surplus all items at zero value and Dee Ann Lawrence seconded it. Motion carried.

For informational purposes, Lemburg presented a letter from Center for Rural Affairs providing the county with example wind energy ordinances and requirements that the counties have for the approval of wind energy projects.

CENTRAL SD ENHANCEMENT DISTRICT MEMBERSHIP FEES

The board discussed the amount of money being spent on the Central SD Enhancement District membership fees. They feel the municipalities in Dewey County are benefiting greatly from the enhancement district. The county has not yet utilized the district for any projects. A lengthy discussion was held on how the county can continue to pay the high membership fees. The board advised Lemburg to invite a council member from each municipality to the April 7, 2020 commission meeting to discuss this matter.

LYLE RICHTER, HIGHWAY

SUPERINTENDENT

The highway department received the new motor grader last week and will be putting a packer on it. Richter contacted A-G-E Corporation about the County Road 10 culvert project. A-G-E hopes to have the project complete by April 30, 2020. Bob Keckler stated that he received a complaint on County Road 22. Richter will check on it. A new road agreement with Corson County was presented for approval. No changes were made from the previous year. Rod Enright made a motion to approve the new agreement and Bob Keckler seconded it. Motion carried.

JOB INTERVIEWS

A lengthy discussion was held on when to conduct interviews for the Highway Superintendent and Auditor positions. The board will hold a special meeting on February 19, 2020 at 10:00 a.m. in the Dewey County Courthouse to conduct interviews. The board discussed possibly offering health insurance to help retain employees.

STEVE ABERLE, STATE’S

ATTORNEY

Rod Enright made a motion to go into executive session to discuss poor relief and mental illness claims. Dee Ann Lawrence seconded it and motion carried. The board entered the session with Aberle and Lemburg at 11:27 a.m. The board came back into public session at 11:32 a.m. Bob Keckler made a motion to deny payment since there is no proof of residency and the individuals are eligible for services through IHS. Dee Ann Lawrence seconded it and motion carried.

The board directed Aberle to draw up a written contract for Lemburg to help train the new auditor. The board agreed to pay Lemburg $24.00 per hour plus 7.65% to cover social security and medicare taxes. The contract may be terminated by either party at any time. The board asked Aberle if the Welfare Director position, currently being filled by the auditor, could be given to the State’s Attorney’s Office. Aberle felt that would be a conflict of interest. A lengthy discussion occurred but no action was taken.

Rod Enright made a motion to go into executive session to discuss a personnel matter. Dee Ann Lawrence seconded it and motion carried. The board entered the session with Aberle and Lemburg at 11:48 a.m. Lemburg exited the session at 11:55 a.m. and Custodian Cassandra Ducheneaux entered the session at 11:56 a.m. The board came back into public session at 11:57 a.m. and stated that Ducheneaux will be submitting a letter of resignation to the Auditor’s Office. John Meginness made a motion to accept the resignation and Rod Enright seconded it. Motion carried. The board advised Lemburg to advertise the position and interviews will be conducted at the March 3, 2020 meeting.

Since there was no further business, Dee Ann Lawrence made a motion to adjourn and John Meginness seconded it. Motion carried. A special meeting will be held February 19, 2020 at 10:00 a.m. to conduct interviews for the Highway Superintendent and Auditor positions and the next regular meeting will be held March 3, 2020 at 10:00 a.m. in the Dewey County Courthouse.
