Motion – District No. 1 Minutes dated 10/30/19:  11/5/19:  RS-After reviewing the District No. 1 Minutes dated 10/30/19 their actions follow:

• District No. 1 Motion to accept the nomination for Edna Thompson for the District No. 1 TECA board.  REFERRED to TECA Oyate Committee.

• Motion was made to reconsider.  FAILED.

• Motion was again made to reconsider. APPROVED.

• Motion to rescind previous action that referred the nomination of Edna Thompson to the TECA Oyate Committee and to appoint Edna Thompson to the vacant District No. 1 TECA Board pending all proper documentation is submitted.  APPROVED.

Motion – Financial Requests:  11/5/19:  RS-Approved of a motion to reaffirm the prior action that all financial requests be referred to the Tribal Treasurer, Benita Clark, and to the Budget & Finance Committee.  (NOTE:  No document(s) was submitted for the record.)

Motion – District No. 5 Minutes dated 9/24/19:  11/5/19:  RS-After reviewing the District No. 5 Minutes dated 9/24/19 their actions follow:

• District No. 5 Motion to increase patrolling for District #5 be addressed and referred to the Judicial Committee of Chief of Police.  REFERRED to the Law & Order Committee.

• District No. 5 Motion that all Tribal Programs will not reduce or waive fees, bonds, hunting & fishing license costs for non-members effective immediately.  FAILED.

• District No. 5 Motion that all actions passed and approved by CRST Tribal Council be acted on immediately.  APPROVED.

• District No. 5 Motion that Cheyenne River Sioux Tribe recognize Anthony (Tony) Rivers as the oldest living tribal member who turned 100 years old in April 2019.  DONE.

• District No. 5 Motion for CRST to pay $160.00 towing fee for Deloria Straight Head.  REFERRED to Budget & Finance Committee.

• District No. 5 Motion to have CRST Council direct Cheyenne River Housing Authority to repair the Manor Public Restrooms and to keep them unlocked at all times as well as all Tribal Program restrooms be open for public use.  FAILED.

• District No. 5 Motion to reaffirm District #5 motion to rescind CRST Council health insurance and put that money toward CRST TERO Office for Home Repairs immediately upon council approval.  FAILED.

• District No. 5 Motion for CRST Claims to address and answer any unanswered issues that benefit all CRST Members, to include the Separation of Powers issue referred to them by CRST Council.  REFERRED to Claims & Legislation Committee.

• District No. 5 Motion that District #5 pay and provide firewood for the Eagle Butte Manor in the amount of $100.00 and have District #5 get a quote on PA system for meetings, both to come out of District #5 $3,000.00 annual budget.  REFERRED to Tribal Treasurer, Benita Clark.

Motion – Rescind Tribal Council re:  $300.00 Elderly Stipend:  11/5/19:  RS-Approved of a motion to rescind the Tribal Council action regarding the increase of the elderly stipend to $300.00 until funds are located and to refer to the Budget & Finance Committee.  (NOTE:  No document(s) was submitted for the record.)

Motion – Travel Authorization for Various Meetings:  11/5/19:  RS-Approved of a motion to approve the travel authorization for Tribal Chairman, Harold Frazier; District No. 4 Council Representative, Vincent Dupris; District No. 6 Council Representative, Tater Ward and District No. 3 Council Representative, John Kessler, and any other Tribal Council Representative, that wants to attend the TBIC Meeting & Roads Meeting from November 12-15, 2019 at Washington DC and for District No. 1 Council Representative, Bryce In the Woods, and any other Tribal Council Representative, to attend the Veterans National Meeting in Washington, DC on November 19, 2019.  (NOTE:  No document(s) was submitted for the record.)

Motion – Budget & Finance Committee Report dated 10/30/19:  11/5/19: RS-After reviewing the Budget & Finance Committee Report dated 10/30/19 their actions follow:

• For the Budget Committee to set up a  meeting with the  Cheyenne River Elderly Nutrition Services Board as soon as possible to discuss financial concerns.  APPROVED.

• To refer to the Wakicu Scholarship Program at the Higher Education Department and Veterans Services Office.  REFERRED to Higher Education Department & Veterans Service Office.

• For all Tribal Programs to get 1.9% COLA until further notice.  All employees need to be treated equally.  APPROVED.

• To reaffirm that the Private Home Repair Program be referred to the TERO Commission with no money coming from General Fund.  REFERRED to TERO Commission.

Motion – TECA Grant for Elderly Nutrition Centers:  11/5/19:  RS-Approved of a motion to have the CRST Planning Department submit a TECA Grant for a new Elderly Nutrition Center.  Motion was amended to include all of the outlying Nutrition Centers.  (NOTE:  No document(s) was submitted for the record.)

Motion – Claims & Legislation Committee Report dated 10/30/19:  11/5/19:  RS-After reviewing the Claims & Legislation Committee Report dated 10/30/19 their actions follow:

• To approve Hiring Panel & changes (By Resolution).  WILL BE TAKEN back to Claims Committee.

• To omit in CRST Policies & Procedures, Chapter 8, Section IV., Section 5.  Advancing Annual Leave.  APPROVED.

Motion – Health Committee Report dated 10/17/19:  11/6/19:  RS-After reviewing the Health Committee Report dated 10/17/19 their actions follow:

• To set up a meeting with Travois for possible funding options for the Residential Treatment Center, sober living quarters, etc.  APPROVED.

• To reiterate the previous council action for trackers/GPS be attached to GSA vehicles to improve monitoring and ensure safety for those under the Health Department.  APPROVED.

• To submit an RFP for Billing Services and CEO to process accordingly.  APPROVED.

• To approve by resolution to remove the Great Plains Area Office staff from the Oyate Health at Sioux San facility to ensure space is specifically for these health services and the facility is currently under a 638 contract for services.  APPROVED.  * See Resolution No. 511-2019-CR.

Motion – Law & Order Committee Report dated 10/18/19:  11/6/19:  RS-After reviewing the Law & Order Committee Report dated 10/18/19 their actions follow:

• To refer the Hiring Board and Grievance Board to Claims to revamp.  REFERRED to the Claims & Legislation Committee.

Motion – Remove & Advertise the Vacant District No. 5 Policy Board Position:  11/6/19:  RS-Approved of a motion to remove Doris LeBeau White from the Policy Board Position for District No. 5 and advertise the vacant District No. 5 Policy Board Position for 30 days.

Motion – Felony Conviction within Health Department:  11/6/19:  RS-Approved of a motion to refer the felony conviction within the Health Department to the Administration to handle accordingly.  (NOTE:  No document(s) was submitted for the record.)

Motion – Roads Committee Report dated 9/27/19:  11/6/19:  RS-After reviewing the Roads Committee Report dated 9/27/19 their actions follow:

To have Law Enforcement give monthly crash data to the Department of Transportation.  APPROVED.

NOVEMBER 2019 RESOLUTIONS

Resolution No. 502-2019-CR:  11/6/19:  RS-The Cheyenne River Sioux Tribal Council does hereby support Chairman Frazier’s appointment of a CRST Census 2020 Complete Count Committee, which will be an inclusive and comprehensive volunteer committee to assist in developing a work plan to accomplish the Tribe’s goals for the United States Census 2020 and contains the provision.

Resolution No. 503-2019-CR:  11/6/19:  RS-That the Cheyenne River Sioux Tribal Council adopts the recommendation of the Education Agency and approves of the 2019-2021 Cheyenne-Eagle Butte School Cooperative School Agreement, as revised, and authorizes the Chairman to attest to the execution of said Agreement after approval by the appropriate School Boards and contains the provision.

Resolution No. 504-2019-CR:  11/6/19:  RS-That the Cheyenne River Sioux Tribal Council approves of the Cheyenne River Head Start Emergency Operation Procedures according to the Head Start Performance Standards 1302.102 and the Cheyenne River Head Start Program must establish, train staff, implement, and enforce a system of health and safety practices that ensure that children will be kept safe at all times for the purpose of continuing Head Start Services to eligible children on the Cheyenne River Reservation and contains the provision.

Resolution No. 505-2019-CR:  11/6/19:  RS-That the Cheyenne River Sioux Tribal Council approves of the Cheyenne River Head Start Parent Handbook according to the Head Start Performance Standards 1302.30 and the Cheyenne River Head Start Program must provide high quality early education and child development services and enforce a system of health and safety practices that ensure that children will be kept safe at all times for the purpose of continuing Head Start services to eligible children on the Cheyenne River Reservation and contains the provision.

Resolution No. 506-2019-CR:  11/6/19:  RS-That the Cheyenne River Sioux Tribal Council approves of the Cheyenne River Head Start Program Operations Policy & Procedures according to the Head Start Performance Standards 1302.102 and the Cheyenne River Head Start Program must establish, train staff, implement, and enforce a system of health and safety practices that ensure that children will be kept safe at all times for the purpose of continuing Head Start services to eligible children on the Cheyenne River Reservation and contains the provision.

Resolution No. 507-2019-CR:  11/6/19:  RS-That the Cheyenne River Sioux Tribal Council approves of the Cheyenne River Head Start Transportation Handbook according to the Head Start Performance Standards 1302.102 and the Cheyenne River Head Start Program must establish, train staff, implement, and enforce a system of health and safety practices that ensure that children will be kept safe at all times for the purpose of continuing Head Start services to eligible children on the Cheyenne River Reservation and contains the provision.

Resolution No. 508-2019-CR:  11/6/19:  RS-That the Cheyenne River Sioux Tribal Council approves of the Cheyenne River Head Start and Eagle Storage to install a gate in front of the Main Entrance at the Eagle Butte Center 18 South Main Street not to exceed the amount $1,650.00, which will be paid by the Head Start TECA Grant.  The Cheyenne River Head Start Program must provide high quality education in a safe environment and contains the provision.

Resolution No. 509-2019-CR:  11/6/19:  RS-That the Cheyenne River Sioux Tribal Council does hereby authorize separate and independent 2019-2020 ISDEAA, contracts between the Cheyenne River Sioux Tribe and the BIE for Johnson O’Malley Program funds for the following schools:  District 32-2 Pierre Public School, District 20-3 Timber Lake Public School, and District 20-1 Eagle Butte Public School and contains the provision.

Resolution No. 510-2019-CR:  11/6/19:  RS-That the Cheyenne River Sioux Tribal Council does hereby authorize separate and independent 2019-2020 ISDEAA, contracts between the Cheyenne River Sioux Tribe and the BIE for Johnson O’Malley Program funds for the following schools:  District 64-2 Dupree Public School and the Cheyenne River Sioux Tribe Head Start Program and contains the provision.

Resolution No. 511-2019-CR:  11/6/19:  RS-That the Cheyenne River Sioux Tribe declares that the Great Plains Area Office employees located at the Sioux San campus who are not involved in direct patient care, including the Office of Environmental Health and Engineering, the Area Pharmacy Consultant and all other Area Office Administration and support personnel, are negatively affecting the ability of the Cheyenne River Sioux Tribe and Oglala Sioux Tribe to provide for the patient needs of American Indians in Rapid City by using space needed for direct patient care and contains the provision.
