United States Attorney Ron Parsons announced that a Cherry Creek, South Dakota, man convicted of Assault by Striking, Beating, or Wounding was sentenced on January 2, 2020, by U.S. District Judge Roberto A. Lange.
Myron Flying By, Jr., age 26, was sentenced to 6 months in federal prison, followed by 1 year of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $25.
Flying By was indicted by a federal grand jury on April 9, 2019. He pled guilty on October 8, 2019.
The conviction stemmed from an incident that occurred on January 19, 2019. On that date, Flying By assaulted a man at a house party in Eagle Butte, South Dakota, by punching him in the face.
This case was investigated by the Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Cameron Cook prosecuted the case.
Flying By was immediately turned over to the custody of the U.S. Marshals Service.
